I think the main point would be that they didn't set out to kill him. They set out to apprehend him.

I agree. the manslaughter in Georgia has only two degrees also. intentional or accidental.
Accidental is not that big a deal. I have a feeling they are gonna get convicted of accidental.

I agree that it was self defense once the gun got grabbed. What if you grab at a carjackers gun and he manages to shoot you? is that self defense? What leads to that point is very much the focus of self defense.
This is what we all need to think about. more and more self defense cases are gonna come up. the standard has to be something a jury can agree with. I don't think they will in this case.
I think they will conclude that the rednecks were reckless and did not do the right thing (call the cops) that led to the whole FUBAR
IF... and I don't know this.... they had said that they were doing a citizens arrest? they might have a case. But a CA for what? for going into a house under construction? being a negro in a white area? what is their defense?

Everyone is suspicious when say.... as I have done.... going into a house under construction.if.... there have been houses vandalized say.
Soooo normally how that would play out is you ask the person what they are doing there..... or in this case what they WERE doing there. At that point if they run away you can follow while calling the cops. that is how it should have played out. We will have to see what the evidence is.
But so far? it looks pretty reckless on the white guys side.

Yes. What they did is the very definition of assault in a legal sense. Brandishing a weapon at someone is assault with a lethal weapon. The weapon does not have to be used "successfully" for it to be defined as an assault -- the mere threat of it's use constitutes the crime.

That is one good thing about most of the concealed carry courses people take. They are taught what is and what is not legal to do with a firearm... What and when.

Felony false imprisonment. They were found guilty of that too.
Chasing somebody down, holding them at gunpoint without the authority to do so, then killing them when they try to escape your felony. No brainer, it's never self-defense in that case. Being a moron not knowing you're committing a felony doesn't make it self defense either.
