You don't need to overthrow the judicial branch to overthrow the legislative branch. The legislative branch may write the laws, but it is the courts that ultimately determine if a crime has been committed. As Trump found out, they may not even want to hear your case.

Unless you overthrow the legislative branch merely by not reelecting them, you are breaking the constitutional law.

That's for the SCOTUS to determine. Only the courts get to determine guilt. I guess it comes down to the old question of if the courts don't punish you, or even hear a case against you, did you still break the law?
